Terms of Service

These Terms of Service ("Terms") govern your use of the FitMyCV website ("Website") and application ("App") operated by Gravity Coders ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Description of the service

FitMyCV is an AI-powered career assistant that helps users analyze job offers, evaluate CV compatibility with applicant tracking systems (ATS), and generate tailored CVs and recruiter messages. The Service is provided on a credit basis: each CV generation consumes one credit.

2. Eligibility

You must be at least 16 years old to use the Service. By creating an account, you confirm that you are at least 16 years old and that you have the legal capacity to enter into these Terms.

3. Account registration

To use certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information and to update it as necessary.

4. Credits and payments

The Service uses a credit system. You can purchase credit packs through Stripe. Each credit allows you to generate one tailored CV. Prices are displayed in your selected currency and include applicable VAT.

Refund policy: Credits are generally non-refundable. Refund requests are reviewed on a case-by-case basis. In case of technical failure where a CV generation does not complete, you may retry the analysis through your dashboard without additional charge.

All payments are processed by Stripe. We do not store your full payment card details.

5. User content and data

You retain ownership of your CV and any information you provide. By uploading your CV or job offer, you grant us a limited license to process it solely for the purpose of providing the Service.

You are responsible for ensuring that you have the right to upload and process the information you provide. You must not upload content that is unlawful, infringing, or harmful.

6. AI-generated content

FitMyCV uses artificial intelligence (OpenAI) to generate CV content, analyses, and recruiter messages. While we strive to produce accurate and helpful content, the AI-generated output is not guaranteed to be error-free, complete, or suitable for every situation.

You are responsible for reviewing, editing, and verifying all generated content before using it in a job application. We recommend that you fact-check dates, names, achievements, and other details.

7. Acceptable use

You agree not to use the Service to:

• Violate any applicable laws or regulations.
• Infringe on the intellectual property or privacy rights of others.
• Upload false, misleading, or fraudulent information.
• Attempt to reverse-engineer, disrupt, or overload the Service.
• Use automated scripts or bots to access the Service.
• Impersonate another person or misrepresent your identity.

8. Intellectual property

FitMyCV and its associated code, designs, logos, and templates are owned by Gravity Coders. You may not copy, modify, distribute, or create derivative works from our materials without our written permission.

Generated CV templates are provided for your personal use. You may not resell, redistribute, or sublicense the templates.

9. Limitation of liability

To the maximum extent permitted by law, Gravity Coders shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.

Our total liability for any claim arising out of these Terms or the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

10. Termination

We may suspend or terminate your account if you violate these Terms or if your use of the Service poses a risk to us or others. You may delete your account at any time from the Settings page.

Upon termination, your right to use the Service will immediately cease. Certain provisions of these Terms will survive termination, including those related to intellectual property, liability, and disputes.

11. Changes to the terms

We may update these Terms from time to time. We will notify you of significant changes by email or through the Service. Your continued use of the Service after the changes take effect constitutes your acceptance of the updated Terms.

12. Governing law and disputes

These Terms are governed by the laws of Poland. Any dispute arising from these Terms or the Service shall be resolved by the competent courts in Poland, unless mandatory consumer protection laws require otherwise.
